Review Board Cases

Cases of the 311th Review Board

Callen v. Bleiweis

Held that Ms. Bleiweis was not "actively campaigning" by encouraging her friends to vote, as opposed to encouraging her friends to vote for her

Executive v. Senate

Held that "principle officers" can only apply to the head official of a body and not all of the members of a body; and therefore that the SA Executive Appropriations Committee was not subject to Senate confirmation.

Cases of the 312th Review Board

Miller and Tresler v. Elections Commission, appeal

Held that Nathan Miller and Michele Tresler could not appear on the ballot for submitting one of their required forms late.

Jasinski v. Lowe and Elections Commission

Held that Luther Lowe could not be held responsible for the contents of the tribetonightslate.com website because there was "not sufficient evidence" to link him to it; deferred to the Dean of Students office on social class classifications.

Cases of the 313th Review Board

Lakihani v. Elections Commission

Held that Lakhiani could not appear on the ballot for submitting one of his required forms late, despite technical problems.

Brown v. Elections Commission

Held that Brown could was not guilty of "tampering" because of his exceeding of the spending limit.

Slawter v. Elections Commission

Held that the Elections Commission's placement of an incorrect ballot statement, combined with a close race, was sufficient to re-run an election.

Cases of the 314th Review Board

Luther Lowe v. Executive, appeal

Held that a bill needs to be returned to the Senate in order to be properly vetoed. On appeal, President Scofield's informing of three senators was determined to be sufficient to return something to the senate.

Tanious v. Elections Commission

Held that a 15-minute delay in an election starting coupled with a candidate who may or may not have been a student was sufficient to raise "reasonable doubt" in an election decided by one vote; re-ran the election.

Faulkner v. Elections Commission

Held that the Elections Commission provided insufficient publicity for the paper ballot elections in some races in 2007. Also held that any paper ballot election needs to have a mechanism for study abroad and other students to vote.

10/8/2007: Opinions released. The Review Board will accept petitions of appeal until 11:59 PM, Tuesday, October 23.

10/3/2007: Decision reached 5-2 in favor of Respondents. Opinions are forthcoming.

10/3/2007: Hearing held at at 9:00 PM in Tyler 102.

10/1/2007: Hearing rescheduled for October 3, 2007 at 9:00 PM in Tyler 102.

9/22/2007: The hearing has been postponed.

9/14/2007: A hearing has been scheduled for September 23, 2007 at 2:00 PM. We have requested Tyler 102 for the hearing.
